Abstract EN

Criminal mediation is among the mechanisms developed to end the criminal litigation, and this is between the two parties to the conflict, the accused and the victim with the intervention of a third party, the Public Prosecution.

This new procedure is among the mechanisms that achieve the principle of speedy procedures, which is one of the requirements of a fair trial.

This led to the creation of the Decree 02/15 dated Shawwal 7, 1436 A.H.

corresponding to July 23, 2015 A.D., amending and completing the Algerian Code of Criminal Procedure, entitled Criminal Mediation.

This is to alleviate the judiciary from the accumulation of files, which constitute pressure on the judge, and would affect the judge’s judgments in a way that does not achieve fair trial principles.
