تكمن أهمية تقنية تفويض المرفق العام في أنها أهم أوجه المال العام إذ أنها تأخذ حيزا كبيرا من الخزينة العمومية هذا من جهة من جهة أخرى تعالج الاختلالات التي أظهرتها الأساليب التقليدية في تسيير المرفق العام لذلك فإن المشرع الجزائري نظمها تحت مسمى اتفاقية تفويض العام في مرسوم خاص (المرسوم التنفيذي رقم 18-199 المتعلق بتفويض المرفق العام) و أحاطها برقابة إدارية لحماية المرفق العام من سوء الاستغلال و هدر المال العام تمارس هذه الرقابة السلطة المفوضة من خلال الرقابة القبلية و الرقابة البعدية بداية من إجراءات إبرامها وصولا لدخولها حيز التنفيذ
Abstract EN
The importance of delegating the public utility, being the most important aspect of public finance taking a large portion of the public treasury on one hand, and on the other hand it address the imbalances that have been shown by traditional methods of operating the public utility; Based on that the Algerian regulator regulated it under The name of the Public utility delegation Agreement in a special decree (Executive Decree No.
18-199 related to the delegation of the public utility) and supported it with an administrative control to protect the public utility from misuse and waste of public money.
This oversight exercises delegated authority through previous control and posteriori control, starting with the procedures for its conclusion until its coming into effect.
