The emergence of insurance played an important and effective role in the transformations that civil liability witnessed at the level of its foundation and its function, through its contribution to the transition from responsibility on the basis of error to objective responsibility, and the embodiment of the compensatory function of the civil liability system.

This compensatory function is to compensate the victims, and the endless dependence on the insurance technology in embodying this job into an economic cost that led to the inability of this mechanism to provide the financial capacity that enables it to enhance the opportunities of those affected to obtain fair compensation.

This could allow civil liability to insure contribution of insurance in preserving its role in compensating those affected, and coexist with these new mechanisms.
