يتناول هذا البحث أهم الحوادث البحرية على الإطلاق و التي كانت محل اهتمام من طرف الفقه و القضاء و كذا التشريعات الدولية و الداخلية و هو التصادم البحري باعتبار أن الرحلة البحرية تمتاز بخاصية مواجهة الأخطار بسبب تأثيرات الطقس و الأخطاء مما يستلزم معها قيام مسؤولية المتسبب في حادث التصادم البحري و بالنتيجة تحديد الجهة القضائية المختصة للفصل في النزاع بعد تكييف الحادث باعتباره تصادما بحريا و تقدير التعويضات المستحقة وفقا لمجموعة قوانين داخلية و اتفاقيات دولية أبرمت في هذا الشأن.
Abstract EN
The present research paper deals with maritime accidents in general, and in particular,wiht vessel colision which has been of great interst to jurists and legislators considerieng that this latter is confronted with diverse risks which are related to climete conditions and human errors.
This implies determing the responsible party for collision ,and thus, setting the competent jurisdiction to decide on the dispute and assesses the damages in accordance with the internal laws and the international conventions which have been concluded to this effect.
