تحتل الصفقات العمومية جانبا هاما من أعمال الدولة و ذلك نظرا للدور الفعال الذي تقوم به من أجل تحقيق التنمية الاقتصادية كما تعد من أهم الوسائل القانونية التي تعتمد عليها الإدارة لممارسة نشاطها و تلبية حاجاتها العامة.
لذا و لضمان نجاعة الطلبات العمومية فقد أحاط المشرع الجزائري إبرام الصفقات العمومية بمبادئ أساسية أهمها حرية المنافسة و ذلك من خلال فتح المجال للأشخاص الطبيعية و المعنوية متى توافرت فيهم الشروط المطلوبة للدخول غمار إبرام الصفقات العمومية دون منع أو إقصاء من المشاركة
Abstract EN
Public transactions occupy an important part of the state's business.
This is due to the effective role it plays in order to achieve economic development.
And, it is also one of the most important legal means on which the administration relies to exercise its activity and meet its general needs.
Therefore, and in order to ensure the efficiency of public requests, the Algerian legislator linked the conclusion of public transactions with basic principles.
The most important of which is the freedom to compete, by opening the way for natural and moral persons whenever they meet the conditions required to enter into the conclusion of public transactions, without preventing or excluding from participation.
