يعالج هذا البحث الأزمة الدستورية المتعلقة بشغور منصب رئيس الجمهورية و التي عرفتها الجزائر منذ الاستقلال.
و ينطلق هذا البحث من أهمية منصب الرئاسة الجمهورية في النظام الدستوري ليستعرض الحالات التي شهدتها الجزائر بخصوص شغور هذا المنصب الحساس ثم يستعرض الأسباب التي تؤدي إلى الشعور و الإجراءات الدستورية التي نص عليها الدستور الجزائري لسنة 1996 المعدل و المتمم و المتعلقة بمعالجة هذا الموضوع وصولا إلى الآثار المترتبة على شغور منصب الرئيس بما يضمن استمرار ممارسة مهام قيادة الدولة و يخلص هذا البحث من خلال استعراض كل النقاط سالفة الذكر إلى قصور القواعد الدستورية الموضوعية منها و الإجرائية في المعالجة الدقيقة للموضوع و بقاء العديد من الإشكاليات الدستورية المسكوت عنها بالشكل الذي إلى عدم استقرار النظام السياسي في الجزائر
Abstract EN
This paper deals with the constitutional crisis related to the vacancy of the office of the President of the Republic.
Then it reviews the causes of vacancy and the constitutional procedures related to them stipulated in the 1996 Constitution, down to their implications.
The discussion concludes with the failure of the constitutional rules to accurately address the issue, and the many constitutional problems that were left unaddressed in a way that leads to the instability of the political system in Algeria.
