The aim of the study is to determine the nature of the criticism that Arkoun practices on traditional Ijtihad, which is a criticism that falls within the circle of trying to understand the nature of contemporary Ijtihad and the references it adopts, stressing that it is still haunted by issues that belong to the past and do not belong to the present, thus preventing criticism and creating a Schizophrenia among Muslims, and the depth of the difference between us and German societies.

From this standpoint, it is necessary to deconstruct the structure of traditional ijtihad and expose its ideological backgrounds, by loosening the link between the meaning that inhabits the Qur'anic texts and the concepts that the clerics have formed about it.
