The issue of proving in automated data processing systems crimes raises a number of questions on various levels, particularly in terms of research and investigation procedures as well as the characteristics and nature of the information evidence.

Moreover, encrypting computer data, either stored or transmitted through special protocols via the internet, constitute a major obstacle to crime detection and proof.

Certainly, the relationship between this type of crime, the technical aspect and the fast evolution of technology grants it a specific nature so that the classical provisions aimed at proving the conventional crimes would be unable to deal with a virtual crime scene, requiring developed technical expertise and exceptional specialized skills to obtain the evidence.

Consequently, legislators of different countries all around the world, including Algeria, hasten the set-up of the pillars of a legal system, in the interest of providing a procedural and objective framework to fight against this criminal phenomenon.
