يعتبر المجلس الأعلى للقضاء مؤسسة دستورية استشارية باعتبار أن هذا المجلس يقدم الراي الاستشاري في حالات معينة تتعلق بممارسة رئيس الجمهورية حق العفو وفي المسائل العامة المتعلقة بالتنظيم القضائي وبوضعية القضاة و تكوينهم و إعادة التكوين و هذه الحالات وردت في التعديل الدستوري لسنة 2016 وفي القانون العضوي رقم 04-12 المتعلق بتشكيل المجلس الأعلى للقضاء و عمله و صلاحياته
Abstract EN
The supreme judicil council considers a constitutional consultative institution, given that this council provides advisory opinion in certain cases related to the president´s exercise of the right to pardon, and in matters related to judicial organization and the status of judges, their composition and reconfiguration, and these cases are mentioned in the 2016 constitutional amendment and in organic law no.
04-12 related to the formation of the supreme council of cassation, its work and powers
