Abstract AR
تهدف هذه الدراسة إلى تسليط الضوء على الدور الذي ستمارسه المحكمة الدستورية المستحدثة بالتعديل الدستوري لسنة 2020 في مجال حماية حقوق وحريات الأفراد.
و يتحدد نطاق البحث في هذا الموضوع من خلال تتبع آراء و قرارات المجلس الدستوري الجزائري في إطار عمله الرقابي و التي سجلنا من خلالها محاولاته التحرر من النصوص التي قيدته في هذا المجال إلا أن دوره بقي ضئيلا مقارنة بالحقوق و الحريات الخاضعة لرقابته فهي تطرح مشكلة التعرف على أساليب و تقنيات و مداخل الرقابة الدستورية التي سيعتمدها القاضي الدستوري الجزائري لضبط نشاط السلطات العامة و منعها من التغول و الاعتداء على الحقوق و الحريات و أثر الانتقال من مجلس دستوري إلى محكمة دستورية على ذلك.
وقد كشفت أن المجلس الدستوري تدخل عدة مرات لضبط النصوص كما استعمل تقنية التحفظات و حاول مواجهة الاغفال التشريعي.

و هو ما قد تستفيد منه المحكمة الدستورية التي تم توسيع اختصاصاتها و إثراء بعض الأدوار المنوطة بها في حماية هذه الحقوق و الحريات و هذا من خلال استخدام المنهج التحليلي النقدي بالإضافة للمنهج الوصفي التاريخي و المقارن في بعض الأحيان لاقتراح التوصيات لإثراء مجال عملها.

Abstract EN
This stady aims to shed light on the role whish be playing by the new constitututional court in the filed of protecting the rights and freedoms of individuals.
The scope of resarch on this topic is determined by tracking the opinions and decesions of Algerian constitutional concil, and it raises the problem of methods, techniques and approaches to constitutional oversight that the Algerian constitutional judge will adopt to the activities of public authorities.
It revealed that the constitutional concil intervented to control drafting of texts, and also used the thecnique of reservations, and tried to confront legislative ommission, which could benefit the constitutional court, whose powers have been expaned and enriched of some roles, using the analytical and critical approach, descreptive historical and comparative, to suggest recommandations to enrich her filed of work.
