Abstract EN

The rising number of digital transactions in the current age has led to the expansion of electronic commerce.

The reason behind that lies in the proliferation of digital media, which managed to greatly reduce effort and time, especially among clients and contractors.

The result is a new type of contracts called digital contracts.

Due to the risks surrounding the digital environment—mainly the ence of physical presence—the Algerian legislator sought, in similar fashion to legislators in other countries, to draft laws that govern electronic online transactions.

The purpose for such laws is to protect traders in these modern communication tools; most importantly, the consumer since he is the weakest party in contractual relationships.

Following on that, this research paper attempts to deal with the main points drafted by the Algerian legislator in Act 18-05 that pertains to the practice of electronic commerce; particularly sections concerned with regulations and rules that govern digital contracts.
