Abstract EN

This study deals with an important topic, on the theoretical and practical levels, in the field of liability Civilian Medical malpractice and medical complication.

In addition, the absence of a legislator in north western Syria (liberated areas) Medical complication, but rather set general rules Responsibility governs the harmful act, the harm, and the causal relationship, and therefore there are no specific rules governing civil physician liability.

This study came with the aim of finding out the appropriateness of applying the general rules of responsibility Civilian citizen in case of Medical malpractice and medical complication.

It has been shown that Medical malpractice is subject to the general standard indetermining the error in civil liability, from several sources that are not in agreement.

However, the special and technical nature of medical work and the seriousness it entails raises the question about the concept of medical error, its standard, its image and its effects.

A distinction must be made between Medical malpractice and medical complication, and it turns out that in Syria, the number of cases that are submitted to forensic medicine ranges between 3 possibilities: 60% are medical complications, 30% errors, and 10% malicious claims.The study recommends the necessity to implement the law on medical accountability, which was applied in Syria before 2011, and to form the bodies responsible for its application from a judiciary council and courts affiliated to a Syrian political body, a union of doctors, associations, and specialized medical links, and the adoption of laws and provisions adopted within a unified legal framework, and that all parties are bound to abide by these rules.
