Abstract EN

Since the war started in early 2011, the Syrian land has shared its citizens the pains of war.

It suffered the destruction and sabotage of major archaeological sites, and antiquities were plundered.

International law and international conferences were not enough to ensure adequate protection of the Syrian archaeological sites and antiquities.

Many local residents don’t even care about such conferences or laws.

As a result, the researcher found that the core problem may lie in those factors that the Syrian person comes in contact with on his land.

By this, we mean the absence or inadequacy of local legal texts that have more influence on the will of the Syrian person than the international law.

This paper studies the impact of legal factors on the local response regarding antiquity protection in the northwest of Syria.

Some factors are included in the Syrian Antiquities Law issued pursuant to Legislative Decree 296 of 1969 and later amendments in Law No.

1 of 1999.

Other factors are not expressed in Syrian laws but were dictated by the status quo under war conditions since 2011 and can help, when available, ensure local response regarding antiquities protection.

The paper is divided into two parts.

In the first part, the researcher addresses the impact of legal factors expressed in the Syrian laws on local response.

In the second, he studies the legal factors dictated by the status quo (which could be called actual or supporting legal factors).
