اهتمت القوانين المتعلقة بالجماعات المحلية بالمرافق العمومية المحلية و ظهر ذلك في كل من قانون البلدية والولاية و خصصت لطرق تسييرها أحكام جديدة تتناسب مع واقع و متطلبات تحقيق التنمية الاقتصادية المحلية فسمح المشرع بتسيير المرافق العمومية المحلية التي تنشؤها كل من البلدية والولاية عن طريق مجموعة الطرق المتعارف عليها لكنه و مع ذلك بقي يحتفظ بحق المفاضلة بين هذه الطرق وقد اعتبر قانون البلدية الحالي( 11-10) الأكثر اهتماما بعقد الامتياز بالمقارنة مع قانون الولاية الذي لم يقم بتغيير أحكامه العامة حيث أعاد المشرع التفكير في المكانة التي منحها لعقد امتياز المرفق العمومي المحلي كطريقة للتسيير لكنه و مع ذلك اعتمد على المساواة بينه و بين أساليب التسيير التقليدية.
Abstract EN
laws relating to local groupware interesting with the local public services, the sear shown in both municipal and state laws.
New provisions have been allocated for their methods of management going with the reality and requirements of local development.
The legislator allowed to manage the local services by known methods, But he kept the preference between these methods.
The current municipal law is concerned with the concession contract better than the state law, Where the legislator rethinks for the position given to it; however he reserved the equal right to recourse to it, like other traditional methods.
