The Banking activity is considered one of the vital activities in the country's economic system.

This role makes it a priority for legal systems to ensure that banks do not collapse and go bankrupt.

The Algerian legislation (banking law, commercial law) included a set of mechanisms in order to address the financial deficit of banks, some of which are of an administrative nature and others of a judicial nature.

An examination of these mechanisms concludes that there is insufficient legal regulation in addition to the overlapping procedures and powers between the texts of the banking law and the texts of the commercial law.
