Abstract EN

This study dealt with the effect of mental illness of the convicted person on the execution of the punishment by researching the mental definition of mental illness, and stating how to diagnose the sentenced disease and how important it is for punitive execution, as well as studying the effect of mental illness on punitive execution through the statement of the legal regulation of the mentally ill and the party competent to consider their matter.

Also, this research has shed light on the necessity to open the way for changing the method of punitive treatment in some exceptional cases at the penalty execution stage.

In the research, we adopted the analytical methodology used in the Algerian, Iraq and Kurdish legal systems.

We concluded the research with its conclusions and recommendations.
