The concession contract plays an active and dual role by reducing the burden of management on the state on the one hand, and meeting the general needs of the public on the other, This approach has also become an effective mechanism used by the Department to engage the private sector in the management of public utilities, utilizing private sector skills and foreign expertise, and obtaining high quality in meeting the wishes of individuals and users on the other hand.

We conclude that there is no fundamental law in Algerian legislation regulating this method or this type of contract, but is regulated by a set of scattered legal texts, in terms of rights and obligations, in the interest of the public.
