Abstract EN

The covid-19 pandemic soon transformed from a health crisis to a general crisis that affected various fields, and its impact on the legal field was clearly influenced by the legal arsenal that accompanied the develepment of this pandemic, in the begining, several executive decrees were issued devoted to measures of social divergence and aimed at restricting some rights to the extent necessary to limit the spread of Covid-19 in order to preserve people's lives, however, in order for the pandimic to continue to spread and the human losses to be sustained, it required the use of the criminal law to amend and supplement the provisions of article 459 of the Penal Code, which includes offense of violation of administrative decrees and decisions, and introducing the offense of endangering the lives and physical integrity of others (article 290 bis), all in order to impose respect social divergence measures to end the spread of corona pandemic, however the tow texts raise the problem of legal caracterization for violating covid-19 prevention and control measures.
