Abstract EN

The present study addresses a key issue in the field of Usul ud-Din (Principles of Religion), that is incompetence to observe legal ordinances in case of hysteria.

The study contains a preface introducing the extent to which hysteria impacts legibility to observe legal rulings, a definition of mental illness, and the difference between it and psychological disorder.

The first chapter then highlights the conditions for legibility to legal capacity, the effect of missing such competence on the eligibility of receptive legal capacity ('ahliyyat ul-wujub) and performative legal capacity ('ahliyyat ul-'ada').

The second chapter illustrates the meaning of hysteria and its forms, while the third covers the legal effect of the hysterical persons' behaviors.

The study then concludes with the key findings.
