com : يهدف هذا البحث إلى التعريف بالقرينة في الفقه الإسلامي و تطبيقاتها في القضاء و مدى قوة حجية القرينة في الحكم القضائي في الفقه الإسلامي مراتبها و أنواعها كما يهدف البحث إلى دراسة القرينة في الحكم القضائي و تطبيقاتها في القانون الكويتي و مدى حجيتها ثم معرفة نقاط التشابه و الاختلافي بين القرينة في القضاء عند الفقهاء و القانون الكويتي.
واعتمد البحث على المنهج الوصفي من خلال عرض القرينة عند الفقهاء و تعريفها و مشروعيتها و تطبيقاتها و أراء الفقهاء في حجيتها و تطبيقات القرينة في القانون الكويتي وستخدم المنهج الحواري و التحليلي من خلال المقارنة بين قرينة عند الفقهاء و القانون الكويتي و بيان نقاط التشابه و الاختلاف.
وتوصل البحث إلى نتائج نلخصها بما يلي: لم يتوسع القانون الكويتي في الحكم بالقرينة كما أخذ به الفقهاء بالشريعة الإسلامية و نرى أن الحكم بالقرينة معتبر في القضاء عند الفقهاء و كذلك في القانون الكويتي بالجملة.
فقانون الإثبات في الدعوى بالقانون الكويتي بالنسبة للحكم بالقرينة لا يخالف الفقه الإسلامي بالعموم من الناحية العملية و لكن يختلف من جهة المصدر و تفاصيل العمل بالقرينة.

Abstract EN
This study aims to introduce the general definition of 'Qareenah' in accordance with Islamic Fiqh and its applications in relation to judiciary.
In addition, it proves the effectiveness of 'Qareenah' as a basis of judgmental decisions, and illustrates its different classes and grades in Islamic Fiqh.
This study is also introducing 'Qareenah' in accordance with Kuwaiti law and its applications and how it can affect the judgmental decision.
Both, islamic fiqh and Kuwaiti law have similarities and differences which can be also highlighted.
The study mainly depends on the descriptive approach which presents the definition, effectiveness and applications of 'Qareenah' in Islamic Fiqh in comparison with Kuwaiti Law.
In addition, it supports both, dialogue and analytical approches by comparing the two definitions of 'Qareenah' and their semilarities and differences.
The study results can be listed as follows: Kuwaiti law is not effectively applying 'Qareenah' as the way Islamic Fiqh is applying and relying on.
However, 'Qareenah' is generally considered and applied in judiciary in reference to both Islamic Fiqh and Kuwaiti Law.
As an example, the determination of fact in lawsuit is applied in Kuwaiti Law with no main conflict with 'Qareenah' as defined in Islamic Fiqh, except the variance in source and the way how it is applied.
