Abstract EN

One of the most important topics in the context of Adilah (a textual conjunction derived from a source) of Sahri’ah is a Hadith which is contrary to the Ijma’a (consensus) and practice of Uluma’a.

The importance of this topic stems from the fact that there is little study and research that has been carried out to explore the topic.

This paper precisely addresses this gap in the literature from two aspects or steps: Firstly; this paper starts with a hermeneutic foundation of the topic under investigation, by introducing the meaning of the terms,vocabularies or terminologies used in this paper.

It also introduces stating authoritative of the Ijma’a (consensus) of Uluma’a as a source of ahkam (rules) vis-à-vis a hadith which is contrary to the consensus and practice of Uluma’a.

Secondly, in keeping with the hermeneutic foundation of the topic, this paper highlights and critically discusses a number of Ahadith (plural of Hadith) that are contrary to the consensus and practice of Uluma’a.

It then underlines the reasonings that led the Uluma’a to arrive at a different consensus and practice that is different to those Ahadith.

Lastly; the research concludes by highlighting the most prominent findings and recommendations that the author has unearthed.
