من أهم القضايا المثيرة للمناقشة في الفقه و القانون هو تقييم ماهية الدية كطبيعة قانونية مقبولة في الإسلام و الذي لم تتخذ السلطة التشريعية ماهية واحدة للدية في فترات التشريعية المختلفة بسبب الخلافات بين الفقهاء و المحامين، و قد أدى ذلك إلى تخبط الحاكم.
في المصادر الفقهية و القانونية، اعتبر البعض الدية نوعا من العقاب.
يرى البعض أنها نوع من جبران الخسارة المدنية، و البعض يرى للدية ماهية ثنائية.
و في قانون العقوبات الإسلامي لإيران، الذي تم الموافقة عليها في عام ١٣٩٢، فإن اتجاه السلطة التشريعية هو قبول الدية كطبيعة ذات ماهية ثنائية.
Abstract EN
One of the important and controversial issues of jurisprudence and law is the assessment of the nature of blood money as one of the legal organizations accepted by Islam.
The legislator in different periods of rule of law and the differences between jurists and jurists did not adopt a single nature for the people, and this causes the deception of the courts as much as possible.
In jurisprudential and legal sources, some have considered blood money as a form of punishment.
Some consider it a form of compensation for civil remedy, and some recognize the dual nature of the institution.
In the Islamic Penal Code of Iran approved in 1392, legislator’s tendency is to accept blood .money as an entity with a dualistic nature
