تتعلق دراسة الحال بمبدأ الشفافية و قواعد الإشهار المكرس بموجب المادة 5 من المرسوم الرئاسي 15-247 و الذي تشدد من جهة في فرض قيود شكلية جوهرية تتعلق بإعلان طلب العروض بشكل مفصل و بيانات دقيقة و محددة و ما يترتب عن رفض منح الـاشيرة عند المخالفة.
غير أن المرسوم من جهة أخرى رخص للمصلحة المتعاقدة من أن تتجاوز رفض تأشيرة لجنة الصفقات المعنية.
و حاولنا من خلال هذه الدراسة الربط بين آلية تجاوز مقرر رفض التأشيرة مع الأحكام التشريعية الواردة في القانون 06-01 و توصلنا بالنتيجة لوجود خلل كبير و تناقض وعليه قدمنا مقترحا في الموضوع

This study is devoted to the principle of transparency and the rules of publication enshrined in Article 5 of Presidential Decree No.
24-15, which relates on the one hand to the imposition of substantial formal restrictions linked to the announcement of the request.

However, the decree authorized the contractor to go beyond the refusal of the visa of the competent procurement commission.
Through this study, we tried to link the circumvention mechanism of the visa refusal decision, with the legislative provisions contained in Law 06- 01, and we examined the result we reached, the existence of a major flaw and a contradiction, and we have presented a proposal on the matter.
