Regarding the subject of counterclaim , different opinions have been raised about the fact that claim is with defense or that there is a mere claim.A group of writers has raised this issue as a Kind of defensive defense against the claims of the plaintiff.A group of faculty members have considered counterclaim as claim, meaning that they do not have any defensive role for it.Given the differences in the views expressed in this regard, we have found that, by survey and studying examples of counterclaim, we find that counterclaim is a mere claim, or it can have a defensive character.To better clarify the issue, some of the topics have been referred to in the French, Lebanese, and Egyptian laws.
