تناولت من خلال هذه الدراسة المسؤولية الجزائية للمحافظ العقاري في نطاق إعداد الدفتر العقاري كسند وحيد لإثبات الملكية العقارية في ظل اعتناق المشرع الجزائري نظام الشهر العيني و هدفنا من هذه الدراسة هو تبيان مفهوم الدفتر العقاري و طبيعته و مدى حجيته الثبوتية كمبدأ من نظام الشهر العيني أولا ثم إبراز مسؤولية الجزائية للمحافظ العقاري كموظف عمومي منحه المشرع الجزائري سلطات و صلاحيات واسعة يسهر من خلالها على تسيير المحافظة العقارية التي تعمل على إعداد و تسليم الدفتر العقاري كون المشرع الجزائري لم يقم بحصر و تحديد بدقة النصوص القانونية التي توضح مسؤولية المحافظ العقاري و تبين العقوبات الواجب تطبيقها على كل خرق أو تجاوز يصدر عنه.
Abstract EN
Through this study, we dealt with the penal responsibility of the conservator of mortgages within the scope of the land registry as the only basis for proving the land ownership in the light of the Algerian legislator that embrace the real land publicity system.
Our aim from this study is at first to show the concept of the land registry, its nature and the extent of its authentic confirmation as a principle of the real land publicity system.
Then we aim to highlighting the penal responsibility of the conservator mortgages as a public employee granted extensive powers by the algerian legislator, through which he supervises the real estate governorate that works to prepare and deliver the state regestry.
The fact that the Algerian legislator has not limited and precisely defined the legal texts that clarify the responsibility of the estate conservator of mortgages and indicate the penalties that must be applied to every breach or bypass issued by him.

A travers cette étude, nous avons traité de la responsabilité pénale du conservateur d'hypothèques dans le cadre du cadastre comme seule base pour prouver la propriété foncière à la lumière du législateur algérien qui embrasse le véritable système de publicité foncière.
Notre objectif de cette étude est d'abord de montrer le concept du cadastre, sa nature et l'étendue de sa confirmation authentique en tant que principe du véritable système de publicité foncière.
Ensuite, nous visons à mettre en évidence la responsabilité pénale du conservateur d'hypothèques en tant qu'agent public doté de pouvoirs étendus par le législateur algérien, à travers lequel il supervise le gouvernorat immobilier qui travaille à préparer et à délivrer la regestry d'état.
Le fait que le législateur algérien n'ait pas limité et défini avec précision les textes juridiques qui précisent la responsabilité du conservateur hypothécaire et indiquent les sanctions à appliquer à chaque manquement ou contournement émis par lui
