الفضيلة بالنسبة لابن رشد تجعل الفرد و المجتمع فاضلا في علاقة مترابطة بينهما كما أن الأخلاق و الفضيلة ضرب من الصحة و الجمال و غيابها على مستوى النفس و المجتمع نوع من المرض.
وقد انتبه ابن رشد إلى و ضياع البعد الأخلاقي في الفقه الإسلامي بسبب سيطرة النزعة القانونية للأحكام التي أولعت بتصحيح ظواهر الأفعال و مدى تحقيقها للصورة الشرعية دون مراعاة مقاصدها.
جعل ابن رشد القيم المقصد العام للتشريع الإسلامي و أراد من إبراز العلاقة بين الأخلاق و الفقه و جعلها أساسا ينبني عليه التشريع و مقصدا يوجهه أن يخرج النسق الفقهي من نطاق التقعيد المعياري للأحكام إلى إطار الكليات الغائية المرتبطة بهوية الذات الإنسانية في مستوياتها المتنوعة خاصة المستوى القيمي.
تحاول الورقة البحثية النظر في التقصيد الرشدي للفقه و تجليات الكلية الخلقية في موسوعته الفقهية وتوظيفه للأخلاق كمعنى مراد في الأحكام و إعماله للقاعدة الخلقية في تأويل النصوص و الترجيح بناء على ذلك.
و تنتهج الدراسة المنهج الوصفي و التحليلي التركيبي بالرجوع المباشر إلى كتب ابن رشد الحفيد و كذا الكتابات ذات الصلة بالموضوع.
Abstract EN
The Virtue according to Ibn Rushd makes the individual and society virtuous in an interdependent relationship between them, just as morals and virtue are a form of health and beauty, and their absence is a kind of disease.
Ibn Rushd was aware of the loss of the ethical dimension in Islamic jurisprudence due to the dominance of the legal tendency of the rulings that devoted themselves to correcting the phenomena of actions and the extent to which they achieved the legal image while observing their objectives.
Ibn Rushd made values the general destination of Islamic legislation; And he wanted to highlight the relationship between ethics and jurisprudence for the jurisprudential system to be removed from the scope of the normative constraint of rulings to the framework of the teleological faculties linked to the identity of the human subject in its various levels, especially the value level.
