The purpose of this research paper is to clarify the legal concept of masterful preparation as a drug produced by the pharmacist ,it also aims to research pharmaceutical liability for damage caused by defective drugs as a product of them.

The product liability regime adopted by the Algerian legislature under article 140 bis of the Civil Code is insufficient to determine legal protection for patient affected by detective descriptors ,it is necessary to seek legal solutions that provide the necessary protection for him.
