the crux of this This paper is dedicated to clarifying some issues that appeared in the Islamic Occident because of inheritance and its censequences, such as cuting kinship ties, dismantling the family, and the emergence of conflicts over inheritance, especially if the divisions are not respected.

Consequently, a big number of incidents (Nawazil) had arisen to treat these conflicts that resulted from segregation in sharing inheritance, or sharing money between some heirs and their heirs , or the existence of any autorisation that gives them the right to commit money before the death of the inherited person.

These illegitimate processes lead to prompt dispute between heirs, especially, if they fail to reach agreement, and therefore , some of them become victims of the delay in sharing inheritance,and they don’t benefit from it in time.

And over the years, if one of them dies, his or her son and daughters will take part in the inheritance, and thus, the number of the inheritance increases as well as conflicts, that is,the heritage remains inaccessible for years without being shared or invested.

In order to investigate this situation in the Occident, we’ve appreciatedtackling the fact of ‘Nawazil’ and legislation in the Islamic Occident to from a generic image about that period through books of Meghrebian Nawazil and the extentto which conflicts influence social relations between members of the family, between relatives, and aven between other members of the community, and the extent to which they influence economy too.
