إن عدم وجود قانون أساسي ينظم مهنة المرقي العقاري أدى إلى تعرض المقتنين في عقد البيع على التصاميم إلى عدة مخاطر أهمها التأخر الكبير في إنجاز المشاريع العقارية و عدم احترام المواصفات المتفق عليها بالإضافة إلى تعرضهم للنصب و الاحتيال من طرف شركات وهمية و هذا في ظل غياب عقوبات تطبق على المرقي العقاري ولتوفير الحماية اللازمة للمقتنين قام المشرع بموجب القانون رقم11 -04 الذي يحدد القواعد التي تنظم نشاط الترقية العقارية بتنظيم هذه المهنة حيث أصبحت ممارستها تخضع للحصول المسبق على الاعتماد كما نظم العقوبات الإدارية التي يتعرض لها المرقي العقاري في حالة عدم احترامه لقواعد أخلاقيات المهنة أو إخلاله بالتزاماته المهنية و التي قد تصل إلى السحب النهائي للاعتماد
Abstract EN
to provide the necessary protection for the acquirers in the contract of sale on designs, through the Law 04-11 which defines the rules and guidelines governing the activity of real estate promotion, the legislator has regulated the profession of real estate promoter, whereby its practice is subject obtaining prior approval, as well imposing administrative penalties subjected to the real estate promoter, in the event that he does not respect the rules of professional ethics, or the breaching of his professional obligations, which may even extent to the total withdrawal of accreditation.
