جاء إنشاء قانون دولي جنائي ثمرة مسار تاريخي لعبت فيه التجارب الواقعية ممثلة في المحاكم العسكرية بعد الحرب العالمية الثانية و المحاكم الجنائية الدولية الخاصة دورا محوريا لإنشاء المحكمة الجنائية الدائمة لكن بقي تفعيل عمل المحكمة يطرح تحد كبير خاصة فيما تعلق بمسألة المحاكمة المنصفة و السريعة للمشتبه بهم بارتكاب الجرائم الدولية الداخلة في اختصاص المحكمة تهدف هذه الورقة البحثية إلى معالجة الإشكالية السابقة عبر توضيح الحقوق التي يتمتع بها المتهم.
تمثل المحكمة الجنائية الدولية قرينة قاطعة علي إمكانية قيام قضاء جنائي دولي يتوافر على المواصفات الشكلية والموضوعية للقضاء الجنائي الوطني أكثر من ذلك برهان ساطع علي الدور الفعال للعدالة الجنائية الدولية في تحقيق احترام لحقوق الإنسان
Abstract EN
The creation of international criminal law is the fruit of a historical process in which real experiences such us; military courts and ad-hoc tribunals have facilitated the establishment of the international criminal court.
This research paper aims to tackle the matter of the fair trial of suspects' of international crimes by clarifying the suspects' rights.
The ICC is an evidence of the possibility of establishing an international criminal judiciary that meets the formal and objective specifications of national criminal judiciary.
Moreover it is a proof of the effective role of international criminal justice in achieving respect of human rights.
