Abstract EN

The principles of humanity of international humanitarian law represent the minimum human tendency that applies to all times and in all circumstances, and which is accepted even in countries that are not party to the conventions, as they express the prevailing custom among peoples.

On this basis, the focus of our study revolves around the content of the principles of humanity, and the extent of the commitment of the warring parties during international and non-international armed conflicts to abide by them and not violate them.

We divided our study into two sections.

In the first we discuss the principle of developing war between states and the Martens clause, and in the second we discuss the principle of distinction.
