The electronic litigation system is the product of the informatics revolution and the technological development, as most international and domestic legislation adopted it within its legal and judicial system, because of its rapid adjudication and relieve the burden on the counterparts, and successful justice, and improve the quality of judicial work, the aim of the study is to give an definition of the electronic litigation system; and its statement of the elements and the various challenges to which it is applied; Therefore, we decided to divide this study into three main axes, and we concluded that although the electronic litigation system is of great importance, its application raises several problems with regard to its underlying fundamentals, its respect for fair trial guarantees and the rights and freedoms of the accused, and the personal conviction of the judge; add to electronic crimes in the field of electronic litigation.
