Abstract EN

This study tackles the subject of the death penalty under the provisions of international human rights law because of its dangerous implication on the right to life, and it is one of the toughest punishments.

It also aims at highlighting the stance of international law towards it and the existing disagreement between states regarding whether to implement it or not.

The study concluded that despite the provision of the abolition of the death penalty in international, regional, European, American, Arab and African human rights conventions, and the adoption by the international community of several actions to abolish the death penalty, a divergence remains between States about maintaining, abolishing or freezing it, and most of the countries that still apply this sentence does not guaranty the sentenced rights, and does not respect the international laws and norms regarding a fair trial and many other rules related to human rights.
