The world is living today an information and communication revolution that has caused fundamental changes in different concepts and patterns of life domains, and at the same time posed a challenge to existing legislation because of the necessity of adapting the latter to what is required by the era of globalization and technological development.

Despite the importance of technology in reducing time, cost, and maintaining the human effort, as well as the proper functioning of all state departments and institutions, in contrast, this development has left negative repercussions and risks that threaten the security of countries and individuals at the same time, in front of the large number of data that is circulating through The virtual community, as the latter became available and used for purposes other than those for which it was given, which violates the privacy of the individual's personal data.

Therefore, we are trying in this research paper to answer the problem based on how to protect personal data from the famous dangers posed by information and communication technology in particular, starting from finding a balance point between protecting the privacy of personal data and benefiting from the fair use of it.

In this context, this study comes to clarify the criminal policy that the comparable legislation has followed to protect personal data as an integral part of the right to privacy, and the effectiveness of this policy in establishing this protection.
