The patent is of great importance.

Patenting is not only advantageous for the inventor but also for the whole society and the economy knowledge-based.

The patent is the granting of property right by a sovereign authority, Algerien national institute of industrial property, to an inventor, allowing him to exclude others from making, using or selling his or her invention during 20 years since the filling day.

During this era the inventor can improve or modificate his original invention, this improvement can be protected by, in Algerian legislation by “certificate of addition”, which grant the same rights than the patent This article discusses certificate of addition’s legal regulation, by focusing on determinate the legal nature of certificate of addition, identify the persons who have the right to request this certificate, and to examining the legal implications that this certificate grant to his author.
