Abstract EN

I divided this research into an introduction, four main parts and a conclusion.

The first part is divided into three sections.

I dealt in the first one with the meaning of Mash-hoor(the most popular view)linguistically.

I've explained in the second one the meaning of Mash-hoor conventionally.

The third section is about the benefit in the divergence concerning determining what isMash-hoor.

The second part deals with what is outweighing (Râjih).

I divided it in turn into four sections.

The first one is about the meaning of outweighing (Tarjîh).

I divided it into four sections.

The first one is about the meaning of outweighing linguistically.

The second is about the meaning of outweighing conventionally.

The third deals with the conditions of judging an opinion as outweighing in the Maliki school.

The fourth section tackles the ways of outweighing when there is a contradiction between the most outweighing and the most popular.

The third part treats the position of not outweighing [a view over the other].

I devoted the third part to the study of Sidi Khalîl's position towards outweighing (Tarjîh) and Tash-heer (considering as the most popular).

The first section of this part is about the position of outweighing.

The second deals with the fact of not giving any opinion.

The third is about not giving preponderance [of one view over the other].

The fourth part studies Sidi Khalîl'sown terms ofTash-heerand Tarjîhand those used by other authors.

The first section of this part is about the terms of Tash-heer and Tarjîh used by Sidi Khalîl.

The second one deals with the terms of Tash-heer and Tarjîhused by other authors.

As for the conclusion, I mentioned thereof the most important findings of the study.
