Legislation has established a special organization for investigation and trial procedures of delinquent children, which differs from the regulation for adults, and the reason for this is that the child's delinquency is due to his young age and his inability to perceive and choose because of his social, mental, psychological, emotional and physical immaturity.

This justifies the existence of child-related penal law, organized by Law 15/12 of July 15, 2015 related to child protection, and these procedures go through several stages, beginning with the collection of evidence, through the investigation stage and then the trial phase.
