Abstract EN

The 2016 constitutional amendment established the right of individuals to submit the Exceptions of Unconstitutionality of legislative provisions which infringing their rights, to the judiciary, then they are referred to the Constitutional Council for deciding in that.

Although, the Constitutional Council was replaced by the Constitutional Court, the 2020 constitutional amendment also preserved the mechanism of Exception of unconstitutionality.

So, this study will attempt to find out Knowing how to exercise it, by studying how they are embodied by the Constitutional Council in its first decisions, considering that the Constitutional Court has not yet been established.
