Abstract EN

Over decades the entire world has suffered from the scourge of war, particularly in the aftermath of the First and Second World Wars.

Being in the past limited to fighters on the battlefield without detriment to civilians, presently wars, with their associated grave losses, have become a matter of concern to all, given the advanced means of warfare and the use of WMD.

According to facts, children are the deliberate target of today’s conflicts, and that the evolution of means of warfare increased causalities particularly among children.

Key forms of child exploitation include recruitment in armed conflicts which render children vulnerable to being killed and maimed.

Children are also at risk of various forms of sexual abuse.

This research turned the spotlight on the suffering of children during international and non- international armed conflicts owing to the seriousness of this issue.

Research also illustrates the attention paid by the international community and Sharia Law in this regard.

Descriptive, inductive method was used for a scientific description of the topic: rules of both International Human Rights and Sharia Laws were examined with a view to coming out with findings and explanations for this problem so that it can be eliminated or prevented in the future.

Research summed up with the finding that Sharia Law recognized children’s rights more than fourteen centuries ago and in a better manner than that of the International Humanitarian Law; International Human Rights Law and other ones which recognized such rights in the 19th and the 20th century.
