Abstract EN

This study is intended to throw the spotlight on the elements of criminal responsibility for the intentional creation of a website linked to a terrorist organization or group.

It also discusses and analyzes the direct intent of creating such website, that is to say the intended purpose.

The most serious purpose of creating such websites is for disseminating information on how to manufacture explosives used in terrorist bombing.

The aim is to draw the attention of Saudi and Emirati communities to how serious such form of cybercrime is so that any obstacles hampering the control of perpetrators be removed, for example, through amending relevant legal provisions.

Additionally, the study urges in depth studying of criminal intent elements of such crime; demonstrates criminal intent types required by Saudi system and UAE law and finally analyzes and compares penalties prescribed for such crime.

Study used the descriptive, analytical approach with a view to achieving its objectives.

Study summed up with a number of findings, chief among them is that Saudi System and UAE Law generally share the same definition for this crime.

However, UAE Law deals exhaustively with that and also with the material element concept in terms of components.

It also deals in detail with instruments used to commit the crime, up to the raw materials used.

Unlike UAE Law, Saudi System, as per findings, is particularly more restrictive in the description of such crime and in the victim status; they agree about criminal intent type.

Provisions of UAE Law and those of the Saudi System differ in dealing with fine: the former regards fine as main, while the latter as main, mandatory and supplementary if accompanied by imprisonment.
