Abstract EN

This study throws the spotlight on Federal Legislator's plan and philosophy on communicable disease control in general, and on the strict legislations aimed at preventing the spread of all communicable diseases including (COVID-19) owing to their adverse health, social and economic impacts.

Legislator had enacted a special law: Federal Law No.

(14) of 2014 on Combatting Communicable Diseases long before the outbreak of (COVID-19).

It is a law intended to counter crimes associated with transmission of such diseases.

It encompassed measures, obligations and restrictions aimed at preventing the spread of such diseases.

It further included deterrent penalties for transmitting infectious diseases to others whether intentionally or negligently.

Study aims to explore ways of criminal confrontation of some crimes associated with transmission of communicable diseases to others whether intentionally or as a result of failure to adhere to preventive measures.

Study explains elements of such crimes; ways of proving them and prescribed penalties.

It moreover sheds light on penalties prescribed for non-adherence to preventive measures and on how adequate these counter measures are.

Study uses descriptive, analytical critical method, and sums up with a number of findings and recommendations.

The latter included introducing amendments to some of the provisions of Law on Combatting Communicable Diseases and adding a new provision criminalizing incitement to deliberate transmission of communicable diseases as a separate crime.
