Abstract EN

Juveniles may perpetrate acts punishable by law; however application of penalties on juveniles is excluded by legislation on grounds of age and cognitive ability.

Therefore, criminalization of and sentences prescribed for juveniles differ from those prescribed for adults.

This study is intended to throw the spotlight on criminal liability of juveniles; time for such estimation.

It also aims to identify stages of juvenile criminal liability, measures which can be taken or sentences prescribed to address juvenile delinquency as per KSA Juvenile System and UAE Juvenile Law, and based on some rulings handed down by Saudi Juvenile Court and by the Federal Supreme Court.

Using descriptive, comparative methodology, study summed up with a number of findings and recommendations, including the following: both KSA system and UAE Law grant judges discretionary power to decide on sentences for juvenile offences, including commutation of sentences; imposing precautionary measures and opting for the specify the duration of precautionary measures imposed on juveniles, while KSA System specifies the maximum duration of such measures.
