Abstract EN

This research aims to identify the role of the supervisory authority in promoting Sharia governance by focusing on the case of the Capital Markets Authority in the State of Kuwait and efforts done in order to promote Sharia governance for licensed persons to operate in accordance with the provisions of Islamic Sharia in the State of Kuwait.

The study relies on the inductive approach to collecting information from the reports and decisions issued in the aspect of Sharia Governance by the Capital Markets Authority, and the analytical approach in analyzing information and data in this regard.

The study concludes that there is an organizational structure that helps support Sharia governance in addition to the existence of several regulations and instructions for Sharia Governance.

The CMA also issued several disciplinary reports and decisions to reinforce the obligation to abide by the Authority’s law and regulations, which is a pivotal role that the Authority plays in order to enhance the application of the Sharia Governance model issued by it, especially that the levels of governance and Sharia governance in Kuwaiti market did not reach the expected level.
