Arabic Abstract

يعد الحق في الصحة حق أساسي لأي إنسان بغض النظر عن أي اعتبارات أخري و من الحقوق الصلبة التي لا غني عنها لأي سبب ما من أجل التمتع بالحقوق الأخرى لذلك يحق لكل إنسان أن يتمتع بأعلى مستوي من الصحة يمكن بلوغه و هذا الحق لا يمكننا تصوره إلا بوفاء الدولة بالتزاماتها و ترتب مسئولياتها ذلك أن الدول و المنظمات الدولية باكتسابها الصفة الاعتبارية و المعنوية تكتسب حقوق و تتحمل التزامات مما يجعلها هي الأخرى خاضعة لإحكام و مبادئ القانون الدولي مثلها مثل باقي الأشخاص الطبيعيين.

و مما لاشك فيه أن التعاون الدولي من أهم وسائل تحقيق التضامن الاجتماعي بين الأمم و الشعوب في شتى المجالات السياسية و الاقتصادية و الاجتماعية و الثقافية و الأمنية و الصحية من أجل تحقيق المصلحة الدولية المشتركة بل أنه يعد كذلك أحد المبادئ القانونية الدولية التي لا يرقى إليها الشك حيث أكدته المواثيق المنشئة للهيئات و المنظمات الدولية و الإقليمية و كذلك العديد من الاتفاقيات الإقليمية و الجماعية.

و تعتبر منظمة الصحة العالمية أحد الوكالات المتخصصة التابعة للأمم المتحدة المعنية بالحفاظ علي الأمن الصحي العالمي إذ تعمل على تقديم المساعدات الفنية المناسبة للدول و تزويدهم بالخدمات و التسهيلات الصحية للتخلص من الأوبئة و الأمراض المستحدثة وفق اللوائح الصحية الدولية المعتمدة عام 2005.

و بعد أن استيقظت البشرية في أوائل عام 2020 على اجتياح فيروس كورونا المستجد (كوفيد-19) لكل الدول عابرا للحدود الجوية و البحرية و البرية حاصدا لأرواح البشر بلا هوادة لم يفرق بين دول الشمال أو الجنوب الشرق أو الغرب دول غنية أو فقيرة غزا الفيروس الإنسان في كل مكان كبار السن أو متوسطي السن و حتي صغار السن و الذي صنفته منظمة الصحة العالمية علي أنه(جائحة عالمية) في الحادي عشر من مارس 2020.

و من أجل ذلك هدفت الدراسة إلى بيان نشأة منظمة الصحة العالمية و الأهداف التي تسعى إليها و الأجهزة الرئيسية التي تعبر عن إرادتها و تمارس باسمها السلطات و التصرفات القانونية المختلفة و دورها البالغ في نشر المعلومات الصحية لكافة دول العالم لمكافحة فيروس كورونا المستجد و ما تقوم به المنظمة لتعزيز التعاون الدولي لمكافحة هذا الفيروس.

English Abstract

The right to health is a fundamental right of any human being, regardless of any other considerations, and a solid right that is indispensable for any reason in order to enjoy other rights, so every human being has the right to enjoy the highest level of health that can be attained, and this right can only be imagined by the fulfilment of its obligations and responsibilities, since states and international organizations, by acquiring legal and moral character, acquire rights and assume obligations, making them subject to the strictest level of international law and principles like the rest of the natural persons.

International cooperation is undoubtedly one of the most important means of achieving social solidarity among nations and peoples in various fields; political, economic, social, cultural, security and health, for the common international interest, but also one of the international legal principles beyond doubt, as confirmed by the charters establishing international and regional bodies and organizations, as well as many regional and collective agreements.

WHO is one of the united nations specialized agencies concerned with maintaining global health security, providing appropriate technical assistance to states and providing them with health services and facilities to eliminate epidemics and diseases, in accordance with the International Health Regulations adopted in 2005.

After humanity woke up in early 2020 to the invasion of the new Coronavirus (Coved-19), all countries across the air, sea and land borders, relentlessly sire human lives, did not differentiate between the North, South East or West countries rich or poor countries that conquered the human virus everywhere, the elderly, the middle age and even the young, which the World Health Organization classified as a global pandemic on 11 March 2020.

For this purpose, the study aimed to show the origin of the World Health Organization, the objectives it seeks, the main organs that express its will and practice in its name the various legal authorities and behaviors, and its great role in spreading health information to all countries of the world to fight the new coronavirus, and what the organization is doing to strengthen international cooperation to combat this virus.

The study also sought to demonstrate international cooperation in the field of health in the face of the Corona pandemic in the light of international conventions and the Charter of the United Nations, and the role of WHO in strengthening cooperation with various states and organizations to address the epidemic.

The study also clarified the obligations of the member states of the organization to cooperate with the organization, as well as the clarification of the international responsibility and its legal basis, and the limits of the international responsibility of states and the World Health Organization for the outbreak of the new coronavirus.

The study contained legal research in this through a preliminary research in addition to four other investigations, and concluded with a conclusion and reached a set of conclusions and recommendations.
