This suggests that it gives balances that are under the control of the state parties, in contrast to the courts established under Security Council decisions.

Nevertheless, the court faces several problems on the ground, which makes the exercise of jurisdiction somewhat difficult, and this complicates the smooth conduct of international criminal justice and establishing the foundations of the international criminal justice
