Abstract EN

Estimating the value of property and real estate rights required to be dispossessed for the public benefit is subject to rules and controls stipulated in Law N° 91-11 amended and supplemented, which is that compensation be based on the real value of the properties and real estate rights dispossessed in a fair and equitable manner covering the entire damage and lost gain and is estimated according to the nature of these properties and their contents and according to their actual use excluding improvements created a year after the pre-investigation was opened in order to obtain a more expensive compensation.

Law N°91-11 does not stipulate the methods and techniques adopted in the evaluation.

Therefore, the national property interests concerned with the evaluation depend on the selection of studied and objective methods and techniques to reach the evaluation according to the prices of the local free real estate market.
