Abstract EN

This legal article addresses the problem of execution of judicial rulings against the administration and the difficulties associated with it because of the public authority privileges.

These privilege allow the administration the possibility of not executing judicial rulings without facing punishment, due the absence of legal requirements which forces the administration to execute.

This issue forced the administrative judge to adopt a broad interpretation of article 7 of the law 90.41 (law regulating Administrative courts) which had made possible the adoption of financial penalties and garnishment as a solution.
