إن التشريع الجزائري كسائر التشريعات العالمية قد كرس مبدأ الحرية الفردية و حرمات المساكن و الأشخاص وضمان الحريات الأساسية الفردية و الجماعية لقد خص الدستور الجزائري مبادئ خاصة بحرمة و حياة المواطن و حرمة مسكنه فأقر بأن الدولة تضمن عدم انتهاك حرمة المسكن و لا تمسه إلا بمقتضى قانون في إطار احترامه و لا تفتيش إلا بأمر مكتوب صادر عن السلطة القضائية المختصة و كذلك جسد قانون الإجراءات الجزائية هذه الحماية.

Abstract EN
Summary: The Algerian legislation, like all other international legislation, has enshrined the principle of individual freedom, the inviolability of homes and people, and the guarantee of basic individual and collective freedoms.
By written order issued by the competent judicial authority, and the Code of Criminal Procedure embodied this protection.
