Abstract EN

This study deals with the position of the local authority in the Tunisian Constitution of January 27th, 2014.

For the first time the decentralized organization in Tunisia was entitled by “the local authority”, the title of Chapter VII from this Constitution.

Hence the significance of the study stems from the important role which the decentralized administration plays in achieving of development at both levels national and local, also in the enhancing of the local democracy.

Further this study aims to highlight how the Tunisian Constitution of 2014 has organized the local communities as an original application of idea of the decentralized administration.

Moreover, it has strengthened its constitutional position.

Given that the Constitution of June 01st, 1959 has marginalized the decentralization, where its legal framework was too vague and brief.

Incidentally this Constitution has mentioned only its structures.
