English Abstract

On October 23, 2017, the new Foreign Residence Law No.

76 of 2017, which contained 54 legal articles and was published in the Official Gazette (Iraqi Facts) with the number 4466, was decided in article (52) to repeal the previous Law on the Residence of Foreigners No.

(118) of 1978, which consisted of 24 articles, but work inthe previous residence law is carried out in accordance with the instructions of the new law.

The reason for the enactment of the new law is due to the ongoing amendments to the Foreign Residence Law No.

118 of 1978 and the emergence of new cases that require a firm review and in accordance with the objective circumstances of the Republic of Iraq and in order to encourage investment and tourism and facilitate access to the entry feature, this has been legalized.

The law aims to regulate the entry and exit of the foreigner into and out of the Republic of Iraq, to determine the types and controls of the entry and departure features of the foreigner to and from the Republic of Iraq and to organize the residence of the foreigner in the Republic.

The new circumstances in Iraq have entailed a great openness and clear interaction in dealing with foreigners, which necessitated that the Iraqi legislator adopt a flexible attitude towards foreigners in general, particularly in terms of facilitating their entry into Iraq and overcoming difficulties in their stay there.

Since the new law contains many new things that need to be researched and studied, we are trying in this research to address the statement of these new matters and provisions brought about by the new Iraqi residency law.

For all of the above, we have found it important to address this issue by researching (recent trends in criminal policy in the Law on The Residence of Foreigners No.

76 of 2017).
